Dynamic Response understands that guidance regarding the current ‘Health And Safety – Control Of Noise At Work Regualtions 2005’ can be confusing for employers. It is an employer’s responsibility to check the noise levels that employees are subjected to, and therefore assess the likely noise risks present.

Information published by the ‘Health And Safety Executive’ indicates that over 1 million employees in Great Britain are exposed to noise levels which put their hearing at risk.


The ‘Control Of Noise At Work Regulations 2005’ which replaces the ‘Control Of Noise At Work Regulations 1989’ should now be applied in all industries, including music and entertainment sectors (except for certain exemptions), to ensure that employees hearing is protected from excessive noise which if ignored could lead to hearing loss and/or tinnitus etc.

HSE Noise At Work Regulation Assessments In Kent

Our Kent noise at work assessments are designed for employers that want, or need to check the noise exposure of employees whilst at work.

Where there is a risk of members of staff and therefore employees being exposed to noise above certain levels, there is a requirement to survey and assess the noise under the ‘Noise At Work Regulations’. The noise at work regulations themselves give limits regarding noise which is expressed as the ‘Lower Noise Exposure’ and ‘Upper Noise Exposure’ action value levels. In addition, there are also other noise limits such as ‘Peak’ or ‘Maximum’ sound pressure values which should be monitored. It should be remembered that an employee’s noise exposure calculation should be based on an average of the typical working day, or even week if required.

When employees noise exposure becomes above the lower action value level, but below the upper action value level, hearing protection must be provided to any employee if requested, whilst if the employee’s noise exposure is above the upper action value level, hearing protection is considered mandatory, and should be enforced by management.

Although hearing protection is considered in the Noise At Work Regulations, it is considered to be a last resort and in fact the regulations state that;

‘the employer shall ensure that the risk from the exposure of his employees to noise is either eliminated at source or, where this is not reasonably practicable, reduced to as low a level as is reasonably practicable’ – Noise At Work Regulations 2005.

Considering the above, the employer should attempt to reduce the noise from activities/processes to a suitable level. In some instances, this may be less expensive than you think, for example, if every item or process in a factory produces noise under the noise regulations but there is a bandsaw cutting a specific material with the wrong blade installed, or even the machines bearing had collapsed, then by rectifying these issues, it may be possible to reduce the noise exposure on all employees affected to a safe level depending on the application rather than simply specifying ear plugs for all employees. However, if for some reason the noise from a process can not be reduced to a safe level, then the particular area/zone affected should be highlighted as a designated hearing protection area/zone.

An increasing number of people are making successful claims for noise induced hearing loss based on current or previous employment. Therefore, failure to check compliance with the noise at work regulation compliance could result in legal implications.
